Last Updated: October 18, 2026
Welcome to HeyHola!
HeyHola is a Spanish-learning application and website developed and operated by Frankly, LLC ("Frankly," "we," "our," or "us").
These Terms of Use ("Terms") explain the rules and conditions that apply when you visit our website at heyhola.app, use the HeyHola mobile application, or access related services (collectively, the "Services").
By accessing or using HeyHola, you agree to these Terms. If you do not agree, please do not use the Services.
About HeyHola
HeyHola helps people learn practical Spanish through real-life situations, visual lessons, conversational practice, and other educational activities.
Our goal is to make Spanish learning approachable, useful, and enjoyable.
Current practice uses locally stored authored content. On-device AI is planned; generative AI, speech recognition, and automated pronunciation scoring are not currently active.
Features, availability, and functionality may change as we continue developing the Services.
Eligibility
HeyHola is intended for users ages 13 and older. You must be at least 13 and legally permitted to use the Services in your jurisdiction.
If you are under the age of majority where you live, you must have permission from a parent or legal guardian to use HeyHola.
Parents and guardians are responsible for supervising their children's use of the Services, as appropriate.
Certain features may have additional age restrictions.
License and acceptable use
Subject to your compliance with these Terms, Frankly grants you a limited, personal, nonexclusive, nontransferable, revocable license to access and use HeyHola for personal, noncommercial educational purposes.
This license does not transfer ownership of the application, its content, or its intellectual property.
You may not:
- Copy, reproduce, or redistribute substantial portions of HeyHola's content without permission.
- Sell, sublicense, or commercially exploit the Services without authorization.
- Reverse engineer, decompile, or attempt to extract proprietary application code, except where permitted by applicable law.
- Circumvent security measures, access restrictions, or purchase controls.
- Use the Services in a way that violates applicable laws or infringes the rights of others.
- Interfere with the operation or security of the Services.
We reserve the right to restrict access when necessary to protect the Services, our users, or our legal rights.
Local-first functionality and your data
HeyHola is designed around a local-first approach.
Certain features may operate without requiring an account or continuous internet connectivity.
Learning progress, preferences, and authored practice content are stored locally on your device. You can manually export learning information to a destination you choose. Android cloud backups are disabled, but device transfers may still occur. On iOS, application data may be included in device or iCloud backups depending on your settings.
You are responsible for maintaining appropriate backups of information stored locally.
Uninstalling HeyHola, resetting your device, or deleting application data may result in the permanent loss of locally stored information.
Frankly is not responsible for data loss resulting from device failures, deletion, operating system changes, or circumstances outside our reasonable control, except where applicable law requires otherwise.
Please review our Privacy Policy for more information about how data is handled.
Educational content
HeyHola provides educational tools intended to help users learn and practice Spanish.
While we work to make our content accurate and useful, language can vary by region, culture, and context.
Translations, pronunciation guidance, examples, and conversational suggestions may not always reflect every regional variation or circumstance.
We do not guarantee:
- Fluency or a particular level of language proficiency.
- Specific learning outcomes.
- Perfect accuracy in every translation or explanation.
- That all expressions are appropriate for every region or situation.
You are responsible for exercising appropriate judgment when applying what you learn in real-world situations.
AI-assisted functionality
On-device AI is a planned capability, not an active feature. Current conversational exercises use authored content. Generative AI, speech recognition, and automated pronunciation scoring are not currently active.
Future AI features, if released, may vary by device, operating system, and application version. We will describe their availability and relevant data handling when introduced. Planned features are not a promise of availability or a particular release date.
Educational content should not be relied upon for legal, medical, financial, emergency, or other high-stakes translation needs.
Purchases and paid features
HeyHola may offer free features, paid upgrades, lifetime access purchases, or optional content packs.
The availability, features, and pricing of these offerings will be displayed before purchase.
If HeyHola offers lifetime access or other one-time purchases, the purchase provides access to the specific features or content described at the time of purchase, subject to these Terms.
"Lifetime" refers to the supported lifetime of the applicable product or offering. It does not guarantee that the Services will remain available indefinitely or that every future product, feature, or content pack will be included.
We may introduce additional features or separately purchased content in the future.
If subscription offerings are introduced, their pricing, billing frequency, renewal terms, and cancellation instructions will be disclosed before purchase.
Subscriptions may renew automatically unless canceled according to the applicable purchase terms.
Purchases made through Apple's App Store or Google Play are processed by the respective platform.
Applicable payments, refunds, cancellations, and billing disputes are generally governed by the platform's purchase policies, subject to applicable consumer protection laws.
We do not directly control Apple or Google's billing systems.
Refunds
Refund eligibility depends on where and how you purchased HeyHola.
For purchases made through the Apple App Store or Google Play, refund requests should generally be submitted through the applicable platform.
Any additional refund rights provided by applicable law remain unaffected.
If we offer direct purchases in the future, we will disclose the relevant refund terms at the time of purchase.
Intellectual property
HeyHola and its associated intellectual property are owned by Frankly, LLC or its licensors.
This includes, where applicable:
- The HeyHola name and branding.
- Pico, Ana, Carlos, and other original characters.
- Illustrations, designs, artwork, and animations.
- Lesson content, exercises, and educational materials.
- Application code and software.
- Website design and content.
- Logos, graphics, and other creative assets.
These materials are protected by applicable intellectual property laws.
Nothing in these Terms grants you ownership of HeyHola's intellectual property.
You may not use our characters, branding, or other protected materials commercially without prior written permission.
Content you provide
Current learning features allow you to practice with authored content and save progress and preferences locally. Speech recording for recognition or pronunciation scoring is not currently active. If future features allow additional content input, their operation and data handling will be explained when introduced.
You retain whatever ownership rights you have in content you provide.
You grant Frankly only the limited rights necessary to process that content for the features you choose to use.
Where processing occurs entirely on your device, your content does not need to be transmitted to Frankly for that processing.
If optional online features are introduced, additional terms or disclosures may apply.
You are responsible for ensuring that content you provide does not violate applicable laws or the rights of others.

Updates and availability
We may update HeyHola to improve functionality, correct errors, introduce features, address security issues, or maintain compatibility with supported devices.
Some updates may be necessary for continued use of certain features.
We do not guarantee that every feature will remain available indefinitely or that the Services will operate on every device or operating system version.
We may modify or discontinue features or services when reasonably necessary.
If material changes affect paid functionality, we will comply with applicable consumer protection laws and provide appropriate notice where required.
